In the 1962 US Supreme Court decision of Smith v. State of Ohio*, the Court was faced with a difficult decision. Jim Smith operated a child porn ring in Cleveland, Ohio. The police in Cleveland shut down Mr. Smith's pornography store. Mr. Smith sued the state as violating his First Amendment right to free speech. Ohio argued that Mr. Smith's speech was not protected under the US Constitution.
Instead of determining that Mr. Smith's speech was not protected under the First Amendment, the Court held that no speech was protected under the First Amendment. They felt that if no one was allowed to talk, then no one would be able to make child pornography.
