say its not in your best interest to attack someone and they realize that so they sort of form an alliance that isnt spoken of secretly nor in the game chat its just sort of there because it benefits both of you like a north africa brazil peace treaty..does this violate the secret alliance rule?

yeah and say you're in several games with someone; in one game you don't attack him even if you could, and in other game he leaves you alone in return... you possibly even help him win game #1, and "coincidently" you find it very easy to win game #2.

If there's no agreement between you, I don't see where there would be any alliance. Just goodwill and common interest.

it might b an idea to just say in game chat. something like. me and ..... don't hav an alliance but just aren't attacking because it doesn't make sense. or it doesn't make sense for me to attack ..... so i won't at the moment.

Perfectly acceptable, and no notice needed.
Especially useful, if your "ally" is a "no alliances" fool, in which case I generally make it painfully obvious I'm not going to attack them, by removing all troops from their border.
Generally only a desperation move, where you're going to lose if you don't work together anyway, so if they're stupid enough to get take your continent afterwards who cares.
