start a 3 player game with someone else with the intention of working together against the 3rd player

sorry if this is the wrong place to put this but i cant think of a better place

How about in a Doubles/Triples/Quadruples game.. are you allowed to scheme with your teammate(s) outside of game chat? I'm thinking about joining a public team game with a real-life friend.

Yes. That's fine. You may communicate with your teammates however you see fit.

As NS said, it's Secret Diplomacy before the game even started. The player joins without knowing he'll be hit by the other two players, which is unfair.

when i play with kp or lany we always use msn

Diplomacy includes, but is not limited to: proposing truces, negotiating alliances, and coordinating assaults. Secret diplomacy can be hard to prove, but if you suspect it you should leave the players in question appropriate ratings. If you feel certain about players engaging in secret diplomacy consider reporting them in the Cheating & Abuse Reports forum by posting a new topic.

Things are there for a reason, although common sense can get you far enough.

In response to your question, if you want to team up against another player in a Terminator/Standard/Assassin Match, and you publicly state "Want to have an alliance Orange" or whatever and he says yes, then yes you can work together.

But not outside of Game chat. If the game style makes it so that you and the player you are making an alliance with cannot both win, it must be in Game Chat.

HOWEVER, if they are your partner, than anywhere you wish to discuss (Live Chat, Walls, PM's, MSN, whatever), you can.

If Owenshooter, freddieparrot and I start a 3 man game and I say (on round 1)

"Hey freddie, let's kill that owenshooter off quick and then go at it 1vs1..yah boo sucks to you owen!"

and freddie says

"Cool." (he doesn't tend to say more than he needs to)

I don't think any rules would have been broken, no?

The alliance would be far from secret. However, if owen could prove we had organised it BEFORE the game had begun then he'd have us bang to rights, lock 'em up and throw away the key etc etc.

Have I got that right?

Yes. However, if you were seen to be doing the same thing, with the same "partner" over-and-over again, You wouldn't be smelling of roses for much longer.
