After 100% of his legislative efforts failed, Biden was finally looking to notch a win in his Supreme Court nominee. But now 49 year old Senator Ben Ray Lujan has had a stroke (days after a booster of the death jab). He's still breathing, meaning he can't be replaced, but hospitalized in New Mexico meaning he can't vote.

Unless he can drag himself back to DC, the GOP will have a functional majority in the Senate.

I'm wishing Lujan a recovery. A slow, relaxed recovery.

Justice Breyer is not actually leaving until the current session ends this summer. We won't hear an actual nomination until that happens. Then we'll have a couple months of hearings and debates, with a vote on the nominee probably occurring in early to mid October - timed to try to extract the maximum possible electoral impact.

It's highly unlikely Senator Lujan's current health issues will be anything but an afterthought by the time the Supreme Court nominee vote occurs.
