Wow, I thought this one was a classic. But you're as close as you could be. It's actually the game that was the foundation and inspiration for worms and so many other popular games [The Genre of Multiplayer Platform/2D shooters]. And it was freeware!! My favorite offshoot is Soldat, which is also good value shareware/donateware.
I still haven't said what the game's name is. Leaving it open...

It looks too advanced for Scorched Earth, so it's definitely not the foundation. :XD
You can probably find this one pretty easily using Google. I remember playing this many years ago. It makes me laugh to think of this game now, and the direct marketing it is. Most of these types of games have moved online and browser based, but I am pretty sure this was on a promotional CD. There may be an abandonware / freeware version of this game available for download somewhere on the net as well.
Chex Quest. (and yes I googled it). Reminds me of all the wolfenstein3D-like sharewares that were released back in those day. Had the creators filled a patent on FPS they would be billionaires by now... On a sidenote I was understand there were some legal issues between CC and Hasbro, are you sure you would be facing a law suit or were their big bad lawyers persuasive enough to deter you from making a too similar game?
